The Supreme Court of NY Rejects a Schismatic Claim on Church Property

On April 16, 2012, Oleg Mikhailovich Rodzianko, former parishioner of Holy Virgin Protection Church in Nyack, NY, filed a claim against the parish with the Supreme Court of the State of NY in Rockland County.

The lawsuit filed by Mr Rodzianko, who had gone into schism, protested so-called attempts to “transfer” the parish and parishioners into the jurisdiction of the Moscow Patriarchate of the Russian Orthodox Church.

On Wednesday, August 22, Justice Robert M. Berliner denied the claim in light of the fact that Mr Rodzianko has no standing in the parish, and moreover that a US court does not have jurisdiction over internal church affairs.

As a reminder, the Supreme Court of the State of New Jersey, over the signature of Justice William C Todd, returned Holy Protection Parish property in Buena, NJ, to the Eastern American Diocese of ROCOR, which had been seized by a schismatic group.
